Terms and Conditions for the Unionpay QRC Withdrawal Service
- This UnionPay QRC Withdrawal Service ("Service") is provided to you by China Construction Bank (Asia) Corporation Limited (the "Bank").
- By proceeding to use the service, you agree to these terms and conditions as the same may be amended from time to time (these "Terms and Conditions") which will bind you. These terms and conditions shall apply, among others, Terms and Conditions for Accounts and Related Services (for Individuals), Terms and Conditions for Electronic Banking Services, Terms and Conditions for Online Banking Services, Licence Agreement and Terms of Use in China Construction Bank (Hong Kong & Macau) Mobile App, Personal Information Collection and Privacy Policy Statement, and such other applicable terms and conditions from time to time issued by the Bank (collectively, the "Relevant Terms and Conditions") as if those terms and conditions are set out in these terms and conditions in full.
- If there is any conflict between these terms and conditions and the other applicable terms and conditions, these terms and conditions shall prevail insofar as the service is concerned.
- If you do not agree to these terms and conditions, you shall not access or use the service or any of its functions.
- Definitions
1.1"ATM" means automatic teller machine.
1.2"ATM Card" means any UnionPay Dual Currency Debit Card (excluding UnionPay ATM Remittance Card and UnionPay Photo Smart Kid Savings Account Card) or such other card as issued and approved by the Bank from time to time for use of the Service.
1.3"Business Day" means a day on which the Bank is open for banking business in Hong Kong but excluding Saturday afternoon.
1.4"Computer System" means the computer equipment, mobile devices, other equipment or devices, and all hardware, software, application and modem connected to or contained therein which is required to access the Electronic Banking Services.
1.5"Daily Aggregated Withdrawal Limit" has the meaning given to it in Clause 5.1.
1.6"Designated Bank Account" means the default bank account in your name pre-approved by the Bank for you to withdraw cash in Hong Kong Dollars and accepted by the Bank for the usage of the Service. The Bank has the sole and absolute discretion to determine which types of bank accounts are eligible as the Designated Bank Account.
1.7"Electronic Banking Services" means any banking service provided by the Bank which enables its customers to obtain information from the Bank, give instructions to the Bank, and effect transactions by ATM, Computer System, telephone or any other device linked to the Bank's system by any means as the Bank may from time to time prescribe, including in particular but not limited to the ATM service and the Online Banking Services.
1.8"Hong Kong" means the Hong Kong Special Administrative Region of the People's Republic of China.
1.9"Minimum Withdrawal Limit" has the meaning given in Clause 5.1.
1.10"Mobile App" means such mobile application software of the Bank as may be designated by the Bank from time to time.
1.11"Network Operators" means any network operators operating and providing ATM.
1.12"Online Banking Services" means the services rendered by the Bank via the Website and/or Mobile App which enable the customer to obtain information or data from the Bank and/or give instructions to the Bank including but not limited to effecting transactions through the Bank by the use of Computer System.
1.13"PIN" means the personal identification number of your ATM Card.
1.14"QR Code" means a quick response code generated by a UnionPay QRC Withdrawal ATM.
1.15"SMS" means a short message service.
1.16"Transaction" means a withdrawal transaction pursuant to the Withdrawal Instruction.
1.17"UnionPay" means UnionPay International Co., Ltd..
1.18"UnionPay QRC Withdrawal ATM" means the applicable ATM in Hong Kong operated jointly by UnionPay and the Bank or jointly by the Bank, UnionPay and/or the other relevant Network Operators from time to time that supports the Service, and allows cash withdrawals by scanning a QR Code without using an ATM Card, but always excluding the ATM operated solely by the Bank.
1.19"Website" means www.asia.ccb.com or such other website(s) as the Bank may from time to time host.
1.20"Withdrawal Instruction" or "Withdrawal Instructions" means the instruction(s) provided by you via the Mobile App for you to withdraw cash from the UnionPay QRC Withdrawal ATM without an ATM Card.
- Scope of Service
2.1The Service is a service offered by the Bank where you may, through the Mobile App, provide your Withdrawal Instruction to the Bank and withdraw cash in Hong Kong Dollars from a UnionPay QRC Withdrawal ATM by scanning a QR Code rather than using an ATM Card.
2.2You acknowledge and agree that in order to use the Service, you must meet the following requirements:
- you must have a valid ATM Card;
- you must be a valid registered user of the Online Banking Services;
- you must log on to the Online Banking Services via the Mobile App to use the Service;
- you must install the Mobile App on your mobile device with camera functionality, activate the camera function on your mobile device, and allow the Mobile App to have access to the camera function of your mobile device; and
- you must have designated a mobile phone number for the receiving of SMS notification from the Bank and an email address for the receiving of email notification from the Bank.
2.3You agree with the following in using the Service:
- You shall log on to the Online Banking Services via the Mobile App installed on your mobile device, select to use the Service and make all your Withdrawal Instructions through the Mobile App.
- You shall give your Withdrawal Instructions via your Designated Bank Account. All Withdrawal Instructions made by you, as recorded by the Bank via the Mobile App, shall be final and binding on you unless there is a manifest error. The Bank shall have the absolute discretion to determine whether or not to accept any Withdrawal Instruction.
- In order to withdraw cash under a Withdrawal Instruction, you shall visit any UnionPay QRC Withdrawal ATM and select to use the Service on the screen of the UnionPay QRC Withdrawal ATM. A QR Code will then be displayed on the screen of the UnionPay QRC Withdrawal ATM. Withdrawal Instructions will only be recognized by UnionPay QRC Withdrawal ATMs; you may not be able to access the Service if you are visiting an ATM that is not an UnionPay QRC Withdrawal ATM.
- Once you submit a Withdrawal Instruction through the Mobile App, you shall select and proceed to scan the QR Code displayed on the screen of the UnionPay QRC Withdrawal ATM using the Mobile App and enter the PIN at the UnionPay QRC Withdrawal ATM.
- A Withdrawal Instruction will remain valid until you are logged out from the relevant session on the Mobile App (whether voluntarily or automatically due to a period of inactivity). If you do not scan the QR Code and enter the PIN at the UnionPay QRC Withdrawal ATM before the end of the relevant session on the Mobile App, the Withdrawal Instruction will expire and be automatically lapsed without the Bank providing you with any further notification. In such a case, the Bank will not and is not obliged to proceed to act on such Withdrawal Instruction and shall not be liable in connection therewith.
- You may cancel your Withdrawal Instruction via the Mobile App before you scan the QR Code or enter the PIN. The Bank has the sole and absolute discretion to determine whether or not to accept any cancellation. Notwithstanding the aforesaid, you may not cancel the Withdrawal Instruction once you have activated the camera on the Mobile App and have commenced the scanning of the QR Code. The Bank shall not be liable in connection to any cancellation of, or failure to cancel, any Withdrawal Instruction.
- You should ensure there are available and sufficient funds in the Designated Bank Account in Hong Kong Dollars before executing a Withdrawal Instruction. The Transaction shall only proceed provided that the scanning of the QR Code and the PIN verification are successful and the Designated Bank Account has sufficient amount of cleared funds in Hong Kong Dollars set out in the Withdrawal Instruction. Otherwise, the Bank will not proceed to act on the Withdrawal Instruction and the Transaction will be rejected by the Bank or UnionPay.
- A SMS and an email notification will be sent by the Bank to your designated mobile phone number and designated email address respectively if the Transaction is successful. You may also check the Transaction record on the Mobile App.
- You shall ensure the amount of cash to be withdrawn as indicated in your Withdrawal Instruction does not fall below the Minimum Withdrawal Limit or exceed the Daily Aggregated Withdrawal Limit. The Withdrawal Instruction will be rejected if the amount of cash to be withdrawn falls below the Minimum Withdrawal Limit or if the Daily Aggregated Withdrawal Limit is exceeded or will be exceeded if the Bank accepts such Withdrawal Instruction.
- UnionPay or the other Network Operators may impose other limits and/or restrictions in relation to your use of the Service. UnionPay may, in its sole discretion, instruct the Bank to delay, suspend or reject any Withdrawal Instruction if such transaction limits and/or restrictions are not complied with.
2.4You may still choose to withdraw cash from ATMs without using the Service, i.e. by using an ATM Card.
2.5You shall ensure that the Withdrawal Instructions and the information therein provided to the Bank are true, complete and accurate in all respects and authorise the Bank to use and/or communicate such information and details with whatever recipients that the Bank may consider appropriate.
2.6The Bank shall be under no obligation to verify the truth, accuracy or completeness of any information supplied by you in the Withdrawal Instructions and the Bank shall not incur any liability arising out of or in connection with any incorrect, inaccurate or incomplete information. You hereby consent to and authorise the Bank to use and/or communicate such information and details with UnionPay, the Network Operators and/or such other third party service provider(s).
2.7You shall comply with all relevant applicable laws, rules and regulations in your dealings with the Bank under the Service and shall provide, in a timely manner, any information (or verification thereof) that the Bank deems necessary to comply with any requirement imposed on the Bank by laws, regulations and international agreements.
2.8The Bank may vary the scope of the Service at any time and from time to time.
- Debiting from the Designated Bank Account
You agree to pay the Bank’s fees and charges in connection with the use of the Service, at such rates as set out in the General Banking Services of Schedule of Service Fees. Your access to and use of the Service through the UnionPay QRC Withdrawal ATM shall also be subject to all other applicable fees and charges chargeable by UnionPay or such other Network Operators.By placing a Withdrawal Instruction, you authorise the Bank to debit directly from your Designated Bank Account the withdrawal amount specified in a Withdrawal Instruction, and the related fees and charges chargeable by the Bank, UnionPay and/or the relevant Network Operators (if applicable). All fees and charges relating to the Service will also be debited from such Designated Bank Account or your any other accounts with the Bank when due and are not refundable.You acknowledge that the Bank, UnionPay or the other Network Operators may modify any such fees and charges in connection with the use of the Service from time to time.
- Acknowledgement of transfer of information to third party service provider(s)
4.1You acknowledge that your information, including the bank account number of the Designated Bank Account and your name under the Designated Bank Account would be passed to third party service provider(s), UnionPay and the Network Operators for processing the Service and/or the Transactions. You hereby consent to the communicating of such information to the relevant parties and confirm that such information are true, complete and accurate in all respects.
4.2You agree to inform the Bank promptly in writing if there are any changes to your information supplied to the Bank from time to time.
- Withdrawal limit
5.1The Bank shall be entitled to impose or amend any minimum amount of each withdrawal (the "Minimum Withdrawal Limit") and amount of the daily aggregated withdrawal limit (the "Daily Aggregated Withdrawal Limit"). The Daily Aggregated Withdrawal Limit is set at the card level, and therefore it applies to all cash withdrawals which you make or attempt to make under your ATM Card (regardless of whether a withdrawal is made by physically presenting the ATM Card or via the Service). Such Minimum Withdrawal Limit and Daily Aggregated Withdrawal Limit shall be set out on the Website. For details, please refer to the Website.
5.2You acknowledge that apart from the Minimum Withdrawal Limit and Daily Aggregated Withdrawal Limit set by the Bank under Clause 5.1, the Transactions will also be subject to the minimum or maximum transaction limit for each UnionPay QRC Withdrawal ATM which may vary depending on the withdrawal policy of UnionPay and/or other Network Operators. The Withdrawal Instruction at a UnionPay QRC Withdrawal ATM will be rejected if such transaction limit is not complied with.
- Suspension or termination of the Service
6.1The Bank may at its sole and absolute discretion, restrict, suspend or terminate all or any part of the Service at any time without notice or giving reason to you if the Bank has reasonable grounds for doing so.
6.2Suspension or termination by you of the Service shall be effective only after notice of such suspension or termination has been given to the Bank and the Bank has a reasonable opportunity to act upon the notice.
6.3Save and except for the circumstances set out in Clauses 6.1 and 6.4 of these Terms and Conditions, the Bank will use its reasonable endeavour to provide prior notice to you (which may be given by any means of communications as the Bank shall see fit, including, without limitation, posting it in the Mobile App or on the Website, in electronic or paper form) of any changes, amendments to, suspensions, restrictions or terminations of the Service. However due to those circumstances as set out in Clause 7.6 of these Terms and Conditions, you accept that prior notice may sometimes not be practicable and therefore not be given.
6.4The Bank may, at its sole and absolute discretion and without prior notice, suspend or terminate the Service immediately if the Bank reasonably decides that you are at any time in breach of any provision of these Terms and Conditions or any other related terms and conditions and agreements.
6.5The Bank shall not be liable for any loss or damage suffered by you as a result of or arising out of any voluntary or involuntary suspension or termination of the Service for any reason whatsoever.
- Disclaimers and Limitation of Liability
In addition to and without prejudice to the provisions in, among others, the Relevant Terms and Conditions, or such other applicable terms and conditions issued by the Bank from time to time:
7.1The Service is offered by the Bank in conjunction with UnionPay or such other Network Operator which manages, operates and maintains the UnionPay QRC Withdrawal ATMs. You acknowledge that the execution of the Withdrawal Instruction under the Service may only be done via UnionPay QRC Withdrawal ATM, in any case subject to and in accordance with the rules, guidelines and procedures imposed by UnionPay or such other Network Operator from time to time and any other relevant terms and conditions prescribed by the Bank, and the Bank shall not guarantee the proper functioning of the UnionPay QRC Withdrawal ATMs. The Bank shall not be liable for any failure of the Bank to perform any obligation or service or take any action where such inability or failure is attributable directly or indirectly to any circumstance or event beyond the reasonable control of the Bank or the reasonable control of its agents or nominees, including any equipment or computer malfunction, power, network or telecommunication failure or inadequacy, interruption, interception, error, delay or loss in transmission or transfer facilities, or the act or omission of any third party.
7.2You are solely responsible for complying with the relevant terms and conditions, including but not limited to transaction limits, of UnionPay, other Network Operators and other third party service provider(s) in connection with the use of Service. The Bank shall not be liable for any failure to proceed with the Withdrawal Instruction if such failure is directly or indirectly caused by your non-compliance with such terms and conditions.
7.3To the extent permitted by law, the Bank makes no representations or warranties that the Service or the UnionPay QRC Withdrawal ATMs will be accessible at all times, or function with any Computer System, software, infrastructure or other Electronic Banking Services that the Bank may offer from time to time.
7.4The Service may only be accessed by using the Mobile App on compatible devices as specified by the Bank from time to time. To the extent permitted by law, the Bank makes no representations or warranties as to the accuracy, functionality or performance of any third party software used in connection with the Service, or the compatibility of any particular device with the Service. You are solely responsible for ensuring your devices meet the specified system requirements. Failure to do so may result in the Mobile App malfunctioning and/or your inability to access the Service.
7.5From time to time updates to the Mobile App may be issued. Depending on the update, you may not be able to use the Mobile App and the Service until you have downloaded the latest version of the Mobile App and accepted any new terms.
7.6You acknowledge that the Service is subject to (and may suffer failure or delay in processing and/or transmitting information as a result of) interruption, failure of hardware or software, errors, transmission blackout, delayed transmission due to internet traffic, or incorrect data transmission due to the public nature of the internet, market volume or volatility, system failure or upgrades or maintenance or for other reasons. The Bank will not be responsible for any consequences arising from any inaccuracy and untimely transmission of information and transactions due to any telecommunication failures occurred beyond its control.
7.7Your use of the Service via the Mobile App is wholly at your own risk. You acknowledge that the Service has not been developed to meet your individual needs and requirements, and therefore you shall have carried out your own risk assessment to arrive at your own decision regarding the use and suitability of the Service. The Service is provided on an "as is" basis. To the extent permitted by law, the Bank disclaims all conditions, warranties (including, but not limited to, any warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement of third party rights), representations or other terms which may apply to the Service, whether express or implied.
7.8The Bank is not responsible for any information or services provided by the third party information providers (whether in the Mobile App or not) and does not accept any liability for the provision of any unlawful, threatening, abusive, defamatory, obscene or indecent information or any type of material which violates or infringes third party rights by such third parties.
7.9The Bank does not represent or warrant that viruses or other destructive properties will not be transmitted, or that your device will not be damaged, during your use of the Service. You are solely responsible for ensuring adequate protection and back-up of data and/or device, for taking reasonable and appropriate precautions to scan for computer viruses or other destructive properties, and for preventing (and guaranteeing and ensuring the prevention of) the transmission of any computer virus to your device.
7.10To the extent permitted by law, the Bank will not be liable for any error, omission, interception, corruption, deletion, loss or inaccuracy in the Service or for any person's use of, reliance on or inability to use such Service, or for any loss or damage (including loss or leakage of data) arising in connection with the Mobile App.
7.11To the extent permitted by law, the Bank is not liable for any loss you may incur:
- in connection with the use or attempted use of the Service, or your instructions, or any unauthorised transactions through or in connection with the Service;
- due to any interruption, delay or any unsuccessful withdrawal of cash at any UnionPay QRC Withdrawal ATM as a result of the unavailability of the Service and/or the unavailability of cash in the UnionPay QRC Withdrawal ATM;
- if your withdrawal account is closed, frozen, or inaccessible for any reason; or
- if you are unable to log-in to the Mobile App to use the Service because you incorrectly keyed in or forgot your username or password, or keyed in an invalid PIN, or were unable to scan the QR Code displayed at the UnionPay QRC Withdrawal ATM through the Mobile App, or otherwise.
- Security
8.1You understand the importance of, and you agree to, protect your mobile device on which the Mobile App is installed, against unauthorised use. You agree that you shall be solely responsible for all uses of your mobile device (whether authorised by you or otherwise) to access and use the Service.
8.2 1. To protect your privacy and assets, you agree to, in addition to all other security measures the Bank suggested in the relevant terms and conditions, take all reasonable precaution steps in a timely manner to keep your device, login information, password, QR Code, PIN and bank or account related information confidential and secure and to prevent unauthorised use of your device, including but not limited to:
- not to disclose to, share with, allow access to or use by anyone your username, password, QR Code or PIN. Please note the Bank may ask you for your username for verification or account re-setting purposes;
- not to disclose or share your device password to any person or allow anyone else to use your login information, password, QR Code or PIN, including any joint account holder, under any circumstances; in particular, do not communicate it via electronic mail;
- not to set a password that is easy to guess (e.g. not to include information such as birthday, telephone number or a recognizable part of your name in setting a password or use the same password to access any other services (for example, to connect to the internet or to access other websites);
- not to use the login information and password for accessing other services;
- not to write down or record the login information, password or PIN without disguising it;
- check your surroundings before using the Service, and make sure that no one sees your device, device password, login information or password, QR Code or PIN. For security purposes, change your device and account password regularly;
- never to write down the login information and password on any device for accessing the Service or on anything usually kept with or near it;
- change your password immediately if you suspect that you have been deceived by a fraudulent website, email, or SMS/WAP push message (for example, if you fail to log in to the Mobile App after inputting your password correctly, with or without any alert messages);
- not to use public or shared mobile devices or public Wi-Fi to access the Service; and
- refer to the security advice provided by the Bank from time to time.
8.3The Bank endeavours to ensure the security of your data transmitted via the Mobile App by the use of encryption technology. However, by using the Mobile App or any of the Service, you acknowledge and agree that internet transmissions are never completely private or secure. You understand that any message or information you send using the Mobile App or any of the Service may be read or intercepted by others, even if there is a special notice that a particular transmission is encrypted.
8.4In the event of any mistakes of fact, loss or unauthorised access or use in respect of your device, login information, password, QR Code, PIN and bank or account related information in connection with the use of the Service, you should as soon as reasonably practicable notify such mistakes, loss or unauthorised access to the Bank in such manner as the Bank may accept from time to time and confirm the same in writing if requested by the Bank.
8.5You shall be solely responsible for adopting the appropriate safeguards and adequate contingency plans (including but without limitation to the above measures) and shall be liable for any loss that results from any unauthorised use or disclosure.
- Indemnity
In addition to and without prejudice to the provisions in, among others, the Relevant Terms and Conditions and such other applicable terms and conditions issued by the Bank from time to time, you shall hold harmless and indemnify the Bank, its affiliates, officers, employees, agents and any other persons appointed by the Bank against any claims, suits, actions, proceedings, losses, damages, obligations and/or liabilities which any of them may incur or suffer, and all costs and/or expenses of reasonable amount and reasonably incurred by any of them as a result of or in connection with (i) your failure to comply with these Terms and Conditions; or (ii) your fraud or gross negligence in your usage of the Service or other Electronic Banking Services provided by the Bank.
- Amendment
The Bank may revise these Terms and Conditions and/or introduce additional terms and conditions at any time and from time to time. Any revision or addition to these Terms and Conditions shall become effective subject to the Bank giving reasonable notice to you which may be given by any means of communications as the Bank shall see fit, including, without limitation, posting it in the Mobile App or on the Website, in electronic or paper form, and shall be binding on you if you continue to use the Service on or after the effective date of the revision or addition.
- Third Party Rights
Save as expressly provided in these Terms and Conditions, no person other than the parties herein may enforce or enjoy the benefit of, any of their terms under the Contracts (Rights of Third Parties) Ordinance (Cap. 623 of the Laws of Hong Kong).
- Governing Law
These Terms and Conditions are governed by, and shall be construed in accordance with the laws of Hong Kong and the parties hereby submit to the non-exclusive jurisdiction of the courts of Hong Kong.
- Language
These Terms and Conditions are available in both English and Chinese versions. The English version shall prevail in the event of any discrepancy between the two versions.
